Subject: 19159/Air Pollution Board Date: Fri, 16 Aug 1991 14:27:00 -0500 RESOLUTION NO. 19159 A RESOLUTION AUTHORIZING THE CHATTANOOGA-HAMILTON COUNTY AIR POLLUTION CONTROL BOARD THE OPTION TO ACCEPT THE PROVISIONS OF THE WORKER'S COMPENSATION STATUTES OF THE STATE OF TENNESSEE. _______________________________ WHEREAS, The Chattanooga-Hamilton County Air Pollution Control Board has approved the purchase and maintenance of worker's compensation insurance coverage for the Bureau pursuant to T.C.A. A750-6-106(5); and WHEREAS, T.C.A. A750-6-106(5) provides that the City of Chattanooga may accept the provisions of the Tennessee Worker's Compensation Law for certain divisions by filing written notice with the Commissioner of Labor at least thirty (30) days prior to any accident or death and such acceptance by the City of Chattanooga shall have effect only of making the division designated subject to the terms of said law; and WHEREAS, the Chattanooga-Hamilton County Air Pollution Control Bureau was jointly created by the City of Chattanooga and Hamilton County and Hamilton County must also consent to such designation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Mayor on behalf of the City of Chattanooga may file written notice with the Commissioner of Labor on behalf of the Chattanooga-Hamilton County Air Pollution Control Board pursuant to T.C.A. A750-6-106(5) accepting the provisions of the Worker's Compensation Law for Chattanooga-Hamilton County Air Pollution Bureau employees only, excluding all other City of Chattanooga employees, subject to concurrent approval of the Board of Commissioners of Hamilton County, Tennessee.
